Can I a Transfer Ownership of a Vehicle to a Family Member with Remote Online Notarization?

The quick answer is, Yes! This can be done either via a traditional in-person notary “wet seal” or via remote online notarization. Either option is permissible in Ontario. 

Who can you gift your vehicle?  

For you to be allowed to transfer your vehicle tax free, you will need to, one of the below family connections will need to be met: 

  • a spouse;
  • parent or step-parent;
  • grandparent or step-grandparent;
  • son/daughter or step-son/daughter;
  • grandson/daughter or step-grandson/daughter;
  • granddaughter or step-granddaughter;
  • son/daughter-in-law;
  • father/mother-in-law; or
  • sibling, half siblings (siblings with a common parent) or adopted siblings (siblings with a common parent through adoption).

Here is what you will need to bring the following documents to a ServiceOntario centre:

  • a completed Sworn Statement for a Family Gift of a Used Motor Vehicle in the Province of Ontario (013-1157E) form (which must be notarized);
  • proof of Ontario vehicle insurance;
  • your Ontario driver’s licence;
  • Safety Standards Certificate (not required for spouse-to-spouse transfers);
  • Vehicle Ownership Permit with the completed portion on the back; and
  • a completed plate transfer declaration if you are also transferring the licence plate (this is required on spouse-to-spouse transfers in order to exempt them from the Safety Standards Certificate).

Only one exempt transfer of the same vehicle, between family members, is allowed within a 12-month period.

Up until very recently, sworn statements were required to be signed and witnessed in-person. The Ontario Ministry of the Attorney General is now permitting lawyers and notaries to virtually witness the physical signing of sworn statements. Once the Sworn Statement for a Family Gift of a Used Motor Vehicle in the Province of Ontario form is complete, you can book an appointment online to notarize the form using our remote online notarization service.
