After the October 7th, 2023 terrorist attacks on Israel, the situation in Gaza has become volatile and unpredictable. With this, Canada has remained deeply concerned about the scale of the humanitarian crisis in Gaza and have engaged in a new public policy program to help refugees.

New Public Policy Conditions for Refugees in Gaza

This new public policy program will provide refugees in the Gaza territory with a temporary path into Canada. The program is designed so that family members based in Canada can support, and sponsor refugees in crisis to leave their affected community in Gaza. Each application will need to have a family member to sponsor the application with financial and non-financial support while in Canada.

Why is the IMM5992 Form needed?

With this program, applicants will need to have an “anchor”, otherwise a Canadian citizen or permanent resident in Canada, to help the applicant with financial and non-financial support while they apply to come to Canada. To prove that the anchor will provide such support, they will need to make an oath in front of a Notary Public and sign the IMM 5992 form, or also called Statutory Declaration to Confirm The Intent to Provide Support To Extended Family Affected by Gaza Crisis

The Anchor in Canada must be the individual that signs this statutory declaration, not the applicant.

Criteria of the Anchor

To be an eligible anchor for the application, one must be:

  • 18 years or older
  • Is a Canadian citizen or permanent resident
  • Resides or intends to reside in Canada

If the anchor does not meet any of the above criteria, he or she cannot sign the statutory declaration, and the applicant will need to find someone else. 

The anchor will also need to confirm that they meet the below criteria, and explain why any conditions are not met:

  • Has the ability to provide financial support upon arrival in Canada
  • Is not under a removal order in Canada
  • Is not detained in any penetentary, jail, or prison
  • Has not been convicted of a serious offense in Canada (Murder or Schedule I or II)
  • Has not been convicted of a serious offense outside of Canada (similar offense to question 7)
  • Is not in any default or debt payable to His Majesty in the right of Canada
  • Not in default in sponsorship or support payments ordered by the courts
  • Not in bankruptcy
  • Not in receipt of social assistance for reason other than disability

Responsibility of the Anchor

The anchor will need to make an oath with a Notary Public while signing the IMM5992 form, that he or she will provide the following support to the applicant upon arrival in Canada: 

  • Meet them at the airport and transport them to their final destination
  • Provide orientation and guidance to life in Canada
  • Provide financial support for their basic needs, including food, housing, clothing, and other basic necessities not covered by public health insurance. 
  • Assistance with: 
    • Coordination with translations services
    • Finding temporary or permanent accommodation
    • Enrolling in public health insurance, social insurance, etc
    • Finding a family physician, dentist, etc. 
    • Enrolling children in school or childcare 
    • Enrolling adults in language training
    • Access support services to find employment

Start and End Date of this Public Policy

The public policy will come into effect on January 9th. The exemptions for foreign nationals who meet the conditions listed in Part 1 and Part 2 will expire once 1,000 applications have been accepted into processing or one year after the public policy comes into effect, whichever comes first.
