Duties a Notary Can Perform: Québec vs. Ontario

In Québec, a notary has more legal authority than an Ontario notary does; Québec notaries go through a different educational program than their Ontario peers. 

In Québec, you must have a Master of Laws in Notarial Law. You must also complete a training program to be admitted to the Chambre des notaires du Québec. In Ontario, a lawyer or paralegal in good standing with the Ontario Law Society can be appointed as a notary public. Here’s a more detailed breakdown of the duties a notary can perform in Québec compared with Ontario.

In Ontario, a notary can:

  • act as a commissioner of oaths
  • not draft legal documents for clients (unless they’re a lawyer)
  • not assist with cases or mediations (unless they’re a lawyer)

In Québec, a notary can:

  • not act as a commissioner of oaths
  • assist with non-contested cases and mediation
  • typically draft the legal documents they notarize
  • provide legal advice to clients (for property law, estate planning, family law, and more)

A Notary’s Seal: Québec vs Ontario

A Québec notary’s signature and seal carries a different meaning than those of an Ontario notary’s. Typically, Canadian notaries outside of Québec primarily focus on verifying signatures and witnessing documents. That said, Québec notaries perform some additional duties.

In Québec, a notary’s seal indicates that:

  • the notary was involved in creating the document
  • the notary followed all applicable laws, regulations and rules
  • the notary ensured there was no bias during the preparation of the document

In Ontario, a notary’s seal means that:

  • they have verified the identity of the person signing the document
  • the signer has signed the document in the notary’s presence
  • the signer was of sound mind while signing, and understood what they had signed
  • the signer is telling the truth
