An Affidavit of Service is a sworn statement confirming that one party has served documents on the other party in a court case. Generally, people in a court case must “serve” documents to the other party per the applicable court rules.

What is the Purpose of an Affidavit of Service in Canada?

A lot of paperwork can be involved in a court case, and everyone who requires copies of documents must receive them. Therefore, parties must serve documents on other parties at specific points in the court process, in accordance with applicable court rules.

  • The manner of service

Certain documents must be served in specific ways. For instance, some initiating court documents cannot be served on an individual by regular mail or fax. That said, a document can usually be served any day of the week, subject to applicable rules, court orders, and deadlines.

Typically, documents can be served using the following methods:

  • Serving the documents yourself

  • Having a friend or co-worker serve the documents
