What is the Declaration of Last Supply under Subsection 31(5) of the Construction Act?

Suppliers of construction materials in Ontario are required to complete this declaration form. The form is required to be notarized to declare the date on which a supplier of services or materials last supplied services or materials under a contract or subcontract. The form also states that the supplier will not supply any further services or materials under the contract or subcontract.

What should your document say?

The completed form should state:

  1. A description of the services or materials that were supplied.
  2. The name of the payer, for example, the company or person you contracted with and supplied the materials too, as well as the date of the contract.
  3. The date of last supply of the materials.
  4. The name and address of your supplier company.
