To complete a Sworn Statement for a Family Gift of a Used Vehicle form, you need to provide:

• Name and address of the recipient
• Name and address of the donor
• Year, make, and model of the vehicle
• Vehicle identification number
• The date on which the vehicle was gifted or transferred

Retail sales tax can be waived when the vehicle transfer is made between any of the following family members:

Note: Only one exempt transfer of the same vehicle between family members is allowed within a 12-month period.

Completing a vehicle ownership transfer is simple, but you’ll need to prepare a few documents before you visit Service Ontario, including:

• A Vehicle Ownership Permit (with the completed portion on the back)
• Proof of Ontario vehicle insurance
• Your Ontario driver’s license
• A completed plate transfer declaration if you are also transferring the license plate
• A Safety Standards Certificate, unless the transfer qualifies for an exemption

If you acquired a vehicle from your spouse or ex-spouse as part of a settlement under the Family Law Act, it may be exempt from retail sales tax. You need to show a supporting document proving that the vehicle was part of the settlement. You’ll need to register at Service Ontario and bring one of the documents below:

• A completed Sworn Statement for the Transfer of a Used Motor Vehicle in the Province of Ontario
• A Separation Agreement
• A divorce agreement
• Another similar court document
