What Is a Sworn Statement for the Transfer of a Used Motor Vehicle in Ontario?

A Sworn Statement for the Transfer of a Used Motor Vehicle (1155E) enables you to request a tax exemption during vehicle registration.

Form 1155E is used only for private sales, not for dealership purchases. When a vehicle is sold privately in Ontario, the recipient may be eligible for a sales tax exemption.

If so, they can complete a Sworn Statement for the Transfer of a Used Motor Vehicle to request this exemption. Depending on the exemption claimed, either the recipient alone or both parties may be required to sign the form.

This form is not used for vehicle transfers between family members; such transfers are considered family gifts. Gifts between qualifying family members require a Sworn Statement for Family Gift of a Used Vehicle form instead.

Note: In Ontario, tax on private vehicle transfers is often referred to as “RST”. However, it is administered under Ontario’s tax rules rather than the former Retail Sales Tax system.

To complete a Sworn Statement for the Transfer of a Used Motor Vehicle form, you need to provide the information below:

  • A vehicle is transferred from an estate to a beneficiary as part of estate administration, regardless of family relationship.
  • A vehicle is acquired between spouses or former spouses after a breakup, as part of a settlement under the Family Law Act.
  • The owner is relocating from another province and registering a vehicle they already own in Ontario.
  • A vehicle is being transferred between related corporations or shareholders.
  • Ownership is registered in another person’s name solely for financing, insurance, or security purposes.
  • The recipient is a foreign diplomat or an eligible international representative.
  • A vehicle is transferred as a result of a civil court order, enforcement, or judgment.

Requesting a Tax Exemption at Vehicle Registration with Form 1155E

First, ensure that you register yourself as the new owner of the vehicle within six days of the transfer. When you visit a ServiceOntario location to complete registration, bring the following documents:

  • A commissioned Sworn Statement for the Transfer of a Used Motor Vehicle
  • A valid Ontario driver’s licence
  • Used vehicle information package (UVIP)
  • Proof of insurance
  • Bill of Sale
  • Safety Standards Certificate
  • Owner’s permit with the ‘Application for Transfer’ portion completed
  • Odometer reading details
  • Emissions test results (if applicable)
  • A plate transfer declaration (if transferring license plates)

Certain individuals (e.g., diplomats, Indigenous recipients) may rely on documentation in addition to or instead of 1155E.

Note: Form 1155E is submitted at ServiceOntario at the time of vehicle registration; it’s not filed separately with the Ministry.
