Frequently Asked Questions
What is an OSAP Affidavit of Common-Law Status?
An OSAP Affidavit of Common-Law Status is a sworn document that confirms you are in a common-law relationship. OSAP may request this Affidavit if you don’t have the documents it requires to establish your common-law status clearly.
OSAP typically verifies common-law status using official documentation. This can include:
- A joint lease or rental agreement
- Joint mortgage or property ownership documents
- Utility bills showing both partners’ names at the same address
- Government-issued documents showing the same residential address
- A previously completed Statutory Declaration of Common-Law Union
In Ontario, individuals are considered common-law if they’ve lived together in a conjugal relationship for at least three continuous years. If they share a child by birth or adoption, they are automatically considered common-law, even before living together for three years.
You may need to submit this Affidavit in the following situations:
- You live with your partner but don’t have joint leases, bills, or financial accounts
- Recently became common-law and don’t have shared documentation yet
- Informally shared housing, such as living with family or roommates
- OSAP asked you to provide sworn confirmation
Do you have Questions about your OSAP Affidavit of Common-Law Status Document ?
What is an OSAP Affidavit?
An OSAP Affidavit helps you complete your OSAP application and secure financial assistance for your studies. You might need one if you lack the documentation OSAP requires to prove a certain status in your OSAP application.
This Affidavit contains a written statement of facts provided by the OSAP applicant, the person making the Affidavit. You must swear or affirm that the contents of your Affidavit are true and sign it before an authorized official, like a notary public or commissioner of oaths.
Providing false information to OSAP may result in penalties under provincial student-aid rules. These can include reassessment, repayment, interest, or restriction from future funding.
Signing an OSAP Affidavit with a Notary Public
In Canada, Affidavits (including your OSAP Affidavit) must be commissioned to be considered valid. This is a necessary step, and without it, your Affidavit isn’t valid.
You can meet with a notary online to have your Affidavit commissioned in 7 minutes, from anywhere with a Wi-Fi connection.
Commissioning an OSAP Affidavit: Step by Step
You can commission your Affidavit online over a secure video appointment. During your online notary appointment, the following will take place:
- You’ll present a piece of valid, government-issued ID to verify your identity.
- You’ll swear or affirm that the contents of your Affidavit are true.
- You’ll confirm that you understand the document and are signing voluntarily.
- You’ll sign and date the Affidavit while a notary witnesses in real time.
- A notary signs and applies their official stamp or seal.

Details an OSAP Affidavit of Common-Law Status Requires
This OSAP Affidavit is used to prove your and your partner’s common-law relationship status. In Ontario, your relationship becomes common-law when you’ve been continuously living together, in a conjugal relationship, for three years outside of marriage. However, if you share a child by birth or adoption, you are considered common-law, no matter how long you’ve lived together. Your Affidavit of Common-Law Status should include:
- A signature from both you and your spouse
- Personal information, including your full name and current permanent address
- Confirmation that you’ve lived in a conjugal relationship outside marriage, continuously for at least three years, or
- State that you’ve lived together in a conjugal relationship of some permanence and share a child naturally or by adoption
